ACCEPTANCE OF TERMS
Welcome to AirplaneFood.Net! AirplaneFood.Net ("AirplaneFood.Net," "us," or "we") provide the Services (defined below) to you ("you") subject to the following Terms of Service ("TOS"), which may be updated by us from time to time without notice to you. You can review the most current version of the TOS at any time by at: http://www.airplanefood.net/termsofservice/. By accessing and using the AirplaneFood.Net services, you accept and agree to be bound by the terms and provision of the TOS. 1.-DESCRIPTION OF SERVICE AirplaneFood.Net provides access to a rich collection of resources, including without limitation to the most up to date airline meal photography database, community forum, news, travel booking tool, and image hosting for travel related subjects. Unless explicitly stated otherwise, any new features that augment or enhance the current AirplaneFood.Net services, including the release of new AirplaneFood.Net properties, shall be subject to the TOS. You understand and agree that the AirplaneFood.Net service is provided "AS-IS" and that AirplaneFood.Net assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or images. AirplaneFood.Net does not claim any ownership interest in any contents that is posted on the Service. 2.-MINIMUM AGE REQUIREMENT You must be at least 13 to use the Service. 3.-CONTENT SUBMITTED OR MADE AVAILABLE FOR INCLUSION ON OUR SERVICE AirplaneFood.Net does not claim ownership of Content you submit or make available for inclusion on our service. However, with respect to Content you submit or make available for inclusion, you grant AirplaneFood.Net the following worldwide, royalty-free, limited, revocable, nonexclusive license described below: a. Content Protected by Intellectual Property Rights. The license to use, distribute, reproduce, modify, adapt, publicly perform, and advertise around your images. This license exists only for as long as you elect to continue to include such content on the AirplaneFood.Net service and will terminate at the time you remove or AirplaneFood.Net removes such Content from the service. This limited license only allows AirplaneFood.Net to use your images on or through the Service. b. Your Warranties Regarding Your Content. By submitting any content to AirplaneFood.net, you warrant and represent the following: i. You have sufficient rights in your Content to post it to the Service and to grant to AirplaneFood.Net the limited license described in these Terms; ii. there are no license fees, clearance fees, and other financial obligations of any kind, arising from any use of your Content on the Service; iii. you are the individual pictured, depicted, and/or heard in your Content or you have obtained permission from each person (including consent from parents or guardians for anyone under the age of eighteen (18)) who appears and/or is heard in your Content to grant the rights to AirplaneFood.Net described in these Terms; and iv. your Content is not defamatory, does not infringe the intellectual property rights, privacy, rights to publicity or any other legal or moral rights of any third party. c. Your Right to Terminate the License. For Content consisting of your images, you may remove such Content from the Service and terminate your license to us at any time. If you want AirplaneFood.Net to stop using your images, simply send us an email by clicking here, requesting us to stop distributing such materials, in which event we will stop using your images within 14 days. So that we can quickly identify the images you want removed from the Service, your notice must clearly identify the Content at issue. The 14 day period for AirplaneFood.Net to stop distributing your Content begins only once AirplaneFood.Net has received a notice complying with the requirements of this Section 3(C). 4.-PROHIBITED CONDUCT You must not do, or attempt to do, any of the following, as reasonably determined by AirplaneFood.Net, subject to applicable law: a. access or use the Service in any way that is not in compliance with any applicable local, state, national or international law (including export laws), contracts, intellectual property rights or constitutes the commission of a tort, or for any purpose that is harmful or unintended (by us), or other than in full compliance with these Terms; b. access, tamper with, or use services or areas of the Service that you are not authorized to access; c. alter information on or obtained from the Service; d. tamper with postings, registration information, profiles, submissions or Content belonging to AirplaneFood.Net or other users of AirplaneFood.Net; e. use any robot, spider, scraper or other automated means or interface not provided by us to access the Service or extract data or gather or use information, such as email addresses, available from the Service or transmit any unsolicited advertising, "junk mail," "spam," or "chain letters" f. frame any part of the Service, or link to the Service, or otherwise make it look like you have a relationship to us or that we have endorsed you or your Content for any purpose except as expressly permitted in writing by AirplaneFood.Net or specifically permitted on the Site; g. impersonate or misrepresent your affiliation with any person or entity; h. reverse engineer any licensed software, application, games or any other aspect of the Service or do anything that might discover source code, or bypass or circumvent measures employed to prevent or limit access to any area, content or code of the Service; i. send to or otherwise impact us or the Service (or anything or anyone else) with harmful, illegal, deceptive or disruptive code such as a virus, "spyware," "adware" or other code that could adversely impact the Service or any recipient; or j. take any action which might impose a significant burden (as determined by us) on the Service's infrastructure or computer systems, or otherwise interfere with the ordinary operation of the Service k. You acknowledge that AirplaneFood.Net may or may not pre-screen Content, but that AirplaneFood.Net has the right (but not the obligation) in our sole discretion to pre-screen, refuse, or remove any Content that is available via AirplaneFood.Net. 5.-MODIFICATIONS TO SERVICE We reserve the right to modify or discontinue, and restrict or block access to, the Service without notice to you. We may remove any user-posted Content from the Service at any time without notice to you, including removal of Content that we believe to be obscene, lewd, lascivious, filthy, excessively violent, harassing, or otherwise objectionable. We are not liable for any such modification, discontinuance or removal. 6.-DEALINGS WITH MERCHANTS; LINKS Advertisements and Links. The Service contains advertisements, offers, or other links to websites of third parties that we do not control. Advertisements and other information provided by third parties may not be wholly accurate. AirplaneFood.Net is not responsible or liable for (i) the availability or accuracy of such sites or advertisements; or (ii) the content, products or services available from such sites. The inclusion of any link on the Service does not imply that we endorse the linked site. You use the links at your own risk. AirplaneFood.Net Privacy Policy is applicable only when you are on our Site. Once you link to another website, its privacy statement applies to any personal information you supply.
7.-INDEMNITY You agree to indemnify and hold AirplaneFood.Net and its agents, partners and licensors harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of Content you submit, post, transmit, modify or otherwise make available through AirplaneFood.Net, your use of the AirplaneFood.Net, your connection to AirplaneFood.Net, your violation of the TOS, or your violation of any rights of another. 8.-TERMINATION You agree that AirplaneFood.Net may, without prior notice, immediately terminate, limit your access to or suspend your access to Services . Cause for such termination, limitation of access or suspension shall include, but not be limited to, (a) breaches or violations of the TOS or other incorporated agreements or guidelines, (b)requests by law enforcement or other government agencies, (c) discontinuance or material modification to the AirplaneFood.Net Services (or any part thereof), (d) unexpected technical or security issues or problems, (e) extended periods of inactivity, and/or (f) engagement by you in fraudulent or illegal activities. Further, you agree that all terminations, limitations of access and suspensions for cause shall be made in AirplaneFood.Net's sole discretion and that AirplaneFood.Net shall not be liable to you or any third party for any termination of your account, or access to AirplaneFood.Net. 10.-VIOLATIONS Please report any violations by using our contact page. ------------------ |
